ACCEPTANCE OF THESE TERMS
These Website Terms and Conditions ("Terms") are a binding agreement between you and The Deep Voice Guy, LLC ("The Deep Voice Guy," "we," "us," or "our") governing access to and use of TheDeepVoiceGuy.biz and its pages, media, forms, and content (collectively, the "Site"). By accessing or using the Site, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Site.
BUSINESS INFORMATION AND SCOPE
The Site presents information about professional voice over, demo production, and related services offered by The Deep Voice Guy, LLC. The Site is intended for general informational, portfolio, and business-inquiry purposes. These Terms govern use of the Site; they do not replace a project-specific contract, proposal, booking confirmation, purchase order, license, invoice, talent-platform agreement, or other written agreement. If a signed or expressly accepted project agreement conflicts with these Terms, the project agreement controls for that project.
ELIGIBILITY
You must have legal capacity to agree to these Terms. If you use the Site for a company or other organization, you represent that you are authorized to act for it. The Site is not directed to children under 13, and children under 13 may not submit forms or personal information through the Site.
QUOTES, AUDITIONS, AND SERVICE REQUESTS
A quote request, audition request, message, or file submission is an inquiry only. It does not create an agency relationship, exclusivity, reservation, obligation to accept a project, or binding service agreement. Rates, availability, timing, usage rights, revisions, cancellations, pickups, payment terms, and deliverables are not final until confirmed in writing. Website descriptions and frequently asked questions are general information and may be superseded by project-specific terms.
Do not use the Site to send highly sensitive personal information. Do not submit confidential scripts, unreleased campaign materials, protected health information, financial account information, trade secrets, or other restricted content unless we have agreed in writing to receive it through an appropriate method. A submission is not subject to a nondisclosure obligation merely because it is sent through the Site.
SUBMITTED MATERIALS
You retain ownership of materials you submit. You grant us a limited, nonexclusive license to host, copy, review, transmit, and use submitted materials solely to evaluate and respond to the request, prepare an audition or quote, perform an agreed project, maintain ordinary business records, and protect legal rights. This license ends when the material is no longer reasonably needed, subject to backups, legal retention, and an applicable project agreement.
You represent that you have the authority and permissions necessary to submit the materials and request the proposed use. You must not submit unlawful, infringing, defamatory, malicious, deceptive, privacy-violating, or technically harmful content. You are responsible for removing personal information that is not necessary for the request.
OWNERSHIP AND PERMITTED USE
The Site and its original content, design, text, graphics, photographs, audio, video, demos, performances, downloads, logos, trade dress, and compilation are owned by or licensed to The Deep Voice Guy, LLC and are protected by copyright, trademark, publicity, contract, and other laws. Third-party names, logos, campaign materials, and marks remain the property of their respective owners and are displayed for portfolio, identification, nominative, or licensed purposes. Their appearance does not imply sponsorship or endorsement unless expressly stated.
You may view and stream publicly available Site content for the limited purpose of evaluating our services or learning about the business. No ownership or commercial-use right is transferred. Except with our prior written permission or as expressly allowed by law, you may not copy, download, reproduce, publish, distribute, broadcast, sell, license, edit, adapt, frame, mirror, remove notices from, create derivative works from, or commercially exploit Site content.
VOICE LIKENESS AND ARTIFICIAL INTELLIGENCE RESTRICTIONS
Without a separate express written license signed by The Deep Voice Guy, LLC, you may not record, capture, download, extract, scrape, isolate, sample, tokenize, index, analyze, create embeddings from, or otherwise use any voice recording, performance, demo, name, image, likeness, persona, or other Site content to train, fine-tune, test, benchmark, prompt, seed, develop, improve, validate, or operate an artificial intelligence or machine-learning system.
You may not create or enable a voice clone, synthetic voice, digital replica, avatar, deepfake, imitation, sound-alike model, dataset, biometric profile, or simulated performance based on Jean-François Donaldson or content from the Site. You may not use automated tools to infer, reproduce, or commercialize vocal characteristics or identity. All rights relating to automated analysis, text and data mining, voice and likeness, and synthetic replication are expressly reserved to the fullest extent permitted by law.
PROHIBITED CONDUCT
You may not:
• Use the Site for unlawful, fraudulent, deceptive, harassing, threatening, defamatory, infringing, or abusive activity.
• Interfere with Site security, availability, or operation; introduce malware; attempt unauthorized access; probe or test vulnerabilities without written authorization; or bypass access or usage controls.
• Use bots, scrapers, crawlers, data-mining tools, or automated agents to collect content or personal information except for ordinary search-engine indexing that respects published technical directives and these Terms.
• Impersonate any person or company, misrepresent affiliation, submit false project information, or use contact details collected from the Site for spam or unsolicited marketing.
• Use Site content in a way that falsely suggests endorsement, partnership, employment, approval, or participation by The Deep Voice Guy, LLC or Jean-François Donaldson.
THIRD-PARTY SERVICES AND LINKS
The Site may link to or display services operated by third parties, including social platforms, video or audio providers, professional profiles, form providers, and an external merchandise store. We do not control and are not responsible for third-party content, availability, security, privacy, products, shipping, returns, payment processing, or terms. Accessing a third-party service is at your own risk and subject to that provider's policies.
NO PROFESSIONAL OR BUSINESS GUARANTEE
Portfolio examples, client names, testimonials, awards, descriptions, blog posts, timelines, and educational materials are provided for general information and to illustrate past work or experience. They do not guarantee any specific creative, financial, search-ranking, casting, booking, or business result. Information may be updated, incomplete, or affected by matters outside our control.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Site is provided on an as-is and as-available basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error-free, secure, current, or free of harmful components. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, The Deep Voice Guy, LLC and its owner, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, revenue, data, goodwill, opportunity, or business interruption arising from Site use or inability to use the Site, even if advised of the possibility.
To the fullest extent permitted by law, total liability arising from or relating solely to the Site will not exceed 100 U.S. dollars. This limitation does not govern liability under a separate project agreement and does not limit liability that cannot lawfully be limited, including liability for intentional misconduct where applicable.
INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Deep Voice Guy, LLC and its owner, personnel, contractors, and service providers from third-party claims, damages, losses, liabilities, judgments, costs, and reasonable attorneys' fees arising from your unlawful Site use, your submitted materials, your violation of these Terms, or your infringement of another person's rights. We may control the defense of a covered claim, and you agree to provide reasonable cooperation.
ENFORCEMENT AND EQUITABLE RELIEF
We may suspend or block access, preserve evidence, and pursue lawful remedies for a violation. Unauthorized use of voice, likeness, recordings, confidential material, or intellectual property may cause harm that money alone cannot adequately remedy. We may seek injunctive or equitable relief in addition to other available remedies.
GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising solely from Site use must be brought in a state or federal court with jurisdiction in the Florida county where The Deep Voice Guy, LLC maintains its principal office, and each party consents to that court's personal jurisdiction and venue. Mandatory consumer-protection rights that cannot lawfully be waived remain unaffected.
GENERAL TERMS
If a provision is held unenforceable, it will be limited to the minimum extent necessary and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign rights under these Terms without our written consent; we may assign them in connection with a business transfer. Headings are for convenience only. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement regarding Site use, but not a substitute for a project-specific agreement.
CHANGES TO THESE TERMS
We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively when posted unless the law requires additional notice. Continued Site use after the effective date constitutes acceptance of the revised Terms.
